I've seen this particular D40 sitting out the back of the dealer in question and you'd be shocked at the condition of it. This guy clearly gives his vehicles a hard time. After seeing the physical condition of the vehicle I am not surprised they have rejected his requests for compensation - no manufacturer would do that if they suspected the vehicle may have been abused or used in a way in which it was not intended (which is the way we use our vehicles if we go offroad despite the pretty advertising pictures).

Yes I agree...he is total tool...but the point wasnt about him in particular. The issues that came about due to the damage the vehicle sustained..Nissan wouldnt get him off the island and his road-side assist wouldnt either. His choice to then drive the damaged vehicle to the barge and off caused the terminal damage....so is it his fault for driving it, personally I believe so. Then again, I have the benefit of training and without judging his skills or education (although how much common sense do you need to not drive a vcehicle with no cooling system) he had to get himself and his vehicle to a point where it can be recovered....was he left with any choice in his mind?
So all in all I believe the poster was very lucky that he was well catered for and the vehicle and he recovered back to a service agent with no real hassles, apart from the embarassment of Toyota onlookers!!
Every vehicle breaks down...even Toyotas....its how you handle the situation that determines how hard a time you have of it and how prepared you are for the inevitable.
