Went into ADR's and Standards awhile back regarding tow requirements etc. and believe me it doesn't make a lot of sense since it seems to be all theory, no actual physical testing is done, vehicle weight to engine capacity/torque/power etc equates to what the max tow weight can be, all science so must be correct.
The max tow ball weight is 10% of the max tow weight nothing about whether or not the arse end will get pulled off the vehicle.
Also all bars, fittings must be stamped with manufacturer and adr stuff to be legal as of a couple of years ago I think. It is a Federal reg which states must comply with.
But rest assured the tow bar will come away from the vehicle before it breaks, it has been proven.

And US ones are rated lower! Our current model 2 door JK has now dropped to 1000kg which is the same that the US has always been, yet my 2010 can tow up to 1600kg with a less power ful motor. For some strange reason though you can still have the 160kg ball weight.

3500kg is max allowable under ADRs for a light vehicle ie car so even of eating higher is technically possible it's not legally possible.
