Unfortunately there is no warranty on electrical items from Poly 4x4. Once it leaves there, it is yours.
Obviously a last-resort, but the aus. consumer rights guarantee essentially covers anything sold through "commerce or trade" (regardless of what they say/think.).
Remember guys, the train of legal liability over this N23 reflash debacle starts with the authorized Jeep dealer who did the reflash and finishes with CF.To put it simply CF have illegally taken low 4x4 from thousands of GC vehicles worldwide and after 8 months still have no fix.Untill somebody legally holds the dealer and or CF responsible nothing will happen.CF either hope this will go away or are worse than useless in their PR.We are all trying to solve this problem when its 100% CFs cockup.!!!

This is basically what members are saying on the US forum. They have had a gutful themselves and are trying all sorts of fixes.
Maybe the legal path is the next step......

I brought a new boat manufactured in NSW from their QLD dealer.
It had problems so I filed in the Brisbane small claims court and the judge ruled the dealer had done nothing wrong and I had to go the manufacturer thru the NSW courts.
So chasing the dealers is useless, and I reckon the judge will say the Jeep importer has done nothing wrong.
Take it up with the manufacturer Jeep USA.
Reality is its cheaper to change cars than fight them.
Update on my Commander with the low-range issue; Albion Jeep says that Chrysler have released a new service boulitin that is supposed to fix all. She's in to get it done as we speak. Fingers crossed!
Tried an experiment this morning.
Removed my new (second hand) non-flashed FDCM (I assume that this is the one under the rear seat on the passenger side) and reinstalled my original flashed one.
Shut the car down, then opened it up and started the vehicle. The 'Service 4WD System' light did not appear, however when I put the car in neutral and engaged 4Low, it would not engage and the 'Service 4WD System' sign popped up straight away.
I then put the re-flashed second hand one back in, shut the car down and restarted it. The 'Service 4WD System' sign popped up straight away, however the 4Low is working every time. For the time being, I'll put up with that wretched warning sign on the dash, knowing that I have my true 4WD back.
