It's usually those that don't think they can afford to have insurance that can't afford to not have insurance. Could turn into a harsh lesson unfortunately. If the other person is at fault I would go straight to their insurance company.

Me too.
A good example of what you say is when I dropped my Ducati while avoiding a car which pulled out in front of me.
The other bloke wasn't insured so he took my insurance company to court, not me.
During this time, the only thing I did was make a couple of phone calls over the next six months for a progress report on the proceedings and to ask when I could expect my pending excess cost of $360 back.
When I finally got the money back, they had squared it off to $400, no reason given.
Can't complain about that, I never even skipped a beer.

I am assuming that you have a loan for the jeep? I think nearly all loan providers demand full comp. insurance as part of your loan contract. Mine does.
That aside his insurance company should be paying you out to replace your written off jeep. Good luck with it all and let us know the outcome.
