The shackles don't need to be factory. but under the ADR's extended shackles are not allowed. So just buy/make some stock length shackles as there simply is no way around it and they can't approve longer shackles.
Track is measured from the centre of tyre to centre of tyre, so its the wheels not the tyres that need to be assessed. (ie what's the spec of your rims?). Although you'd like to think he'd sign off on a small 31" tyre - some can be a dicks about it. The stock tyre was 235/75R15 ie 733mm tall, then a 31" tyre is 787mm = 54mm. The rules specify 50mm...sucks I know but IMHO it may be just easier/cheaper to grab a set of Zuki rims with 235/75r15 tyres and get it passed on those then just swap the existing one back on afterwards.

Whilst there are engineers that would probably do tests to pass larger tyres, to be honest you don't want that because it can be way more expensive for really very little gain.
Swap it to stock it's not much work/cost and then your done. just my 2cents....

What a beautiful looking example.
But those shackles stand out like dogs-balls and not in a good way. Besides the legality and (IMHO) the looks, shackles like that especially in the front will decrease steering response and put extra load on a chassis that isn't really the strongest (infact a few I've seen look like they were welded by a drunk 14yo). Ditching them for stock length is a good move.
BTW if you a going to do a lot of vehicle towing - I'd suggest slight change in your strapping technique. The straps front and rear are a bit small.
My presonal pref is rear drag chain crossed and onto the axle. Pulled tight with the largest strap i have on the front axle. Then second & third strap front & rear for redundancy - both onto the axle.
Only then does the handbrake go on and the gearbox into low first.
Not a fan of strapping bumpers, suspension or body.
Anyhow sorry for the critique, just suggestions.

Those are standard CJ Laredo rims.
Put on the 235 tires then switch back.
The engineer is being a penis.

Nice scrambler, seen it advertised for a while. them shackles just screamed to big it would steer like a blood hound tracking a scent. Still nice rig

Why don't you contact the original engineer to get a copy of the engineering report, could save time & money, I'm surprised the seller hadn't already done that & had the paperwork sorted before you bought it
