As for going uphill, I haven't had the surging etc but got stuck on a sand hill towing my camper when i was trying to keep momentum by staying in second low but kept changing up to third and ran out of speed and stopped. As mine is a MY14 it doesn't have it but I guess they would argue again that you you the ascent control for this as well.

Well with litigation issues, hill descent control, tries to make it muppet proof.
If you can overide that, then a muppet can, that leads to a litigation case. "Why was I able to change gears and lose control", this is the down side of U.S style legal issues.
This probably causes the issue in reverse, when you need to lock it in a gear to provide drive.
I'm sure they could come up with a solution, but it is easy to see where the conflicts come from, writing code for all eventualities is a nightmare.
It's easy to criticise, but the permutations are huge.
