well that is one tight fit. I have also seen a mod where the rectangle air filter was used in the cowl area.
If one is concered about water I would argue that placing the air filter/pod directly in the vent cowl is inviting water to be sucked in.
But if you never drive ya Jeep in the rain shouldnt be a problem

the amount of rain that gets in there.. even with a downpour is hardly enough to do anything more than turn to steam by the time it hits your engine.. the steam would then clean the carbon.. give you a cleaner burn etc.. much like water injection

Excluding claims realated to sucking in water, providing you maintained the filter properly there's nothing this mod could cause to void your engine warranty. It's no different to fitting a snorkel or pod in the usual location when you think about it & no one running those has had issues.

The only time i've read where a pod has caused warranty issues is on a car running an air flow meter. Too much oil on the filter stuffed the sensor and engine tune. But you don't have this concern.

I'd say just do it. But if you're still worried about it, it wouldn't take you long to remove and put the standard stuff back in before services.
